Mediation

The courts in the State of Georgia promote and encourage parties to try to resolve their issues before going to trial through mediation. Sometimes the court orders the parties to attend mediation.

Mediation is a process in which a neutral third party, who is trained to do so, assists in resolving a dispute rather than going to trial. The role of the mediator is to facilitate communication between the parties and/or their attorneys. A mediator can assist in focusing on the real issues of the dispute and help find options that meet the needs and interests of the parties to resolve the conflict.

Unlike an arbitrator or a court, a mediator does not hear the evidence and make a decision for the parties. A mediator assists the parties in developing a resolution themselves.
