Fathers' Rights and Child Custody

Today, Georgia law encourages both parents to be involved in the life of their children.

Unfortunately, for decades mothers have held an inherent advantage in court in matters involving custody rights with children. We have all heard the joke about the elderly South Georgia judge who had just been questioned about his custody ruling in favor of a mother that stated, "Well, I have never seen a bull who could nurse a calf"

This gender bias must be eliminated for our legal system. Fathers' Rights and Visitation

If you are a father that cannot be satisfied with being a weekend dad, we can help! Visitation does not have to be every other weekend, from Friday at 6:00 PM, until Sunday at 6:00 pm. There are many opportunities for additional time with the children when a father does not have sole or even joint custody.

Fathers' Rights -Paternity and Legitimation

You have absolutely no legal rights to see or be involved with your child, or children, if you are a father of a child born outside of marriage who has not legitimated that child!

Prior to legitimation of a child born out of wedlock, the mother is entitled to custody and exercises all parental power over the child

A Paternity suit is often used to establish a biological father's duty to pay child support. Also medical and birth-related expenses incurred by the mother are recoverable from the father. The father cannot be awarded visitation rights or any other rights under the paternity action unless he has filed an action or counterclaim for legitimation. Since a father's duty to support his child arises when the child is born, Georgia law permits the recovery of back child support from the father upon adjudication of paternity.

A biological father must bring a legal action to Legitimate the child to establish his parental rights, custody, visitation, and the child's right to inherit from the father. Once legitimation is granted, the parent/child relationship will be established as if the child were born in wedlock. Issues of custody, visitation, name change, and child support can be addressed with legitimation.
